This Privacy Notice for PointNine Aviation, LLC (“we,” “us,” or “our”) describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use our services (“Services”), including when you:

- Use PointNine Aviation, an online aviation education and mentorship platform that connects students with independent flight and ground instructors for personalized instruction, coaching, mentoring, checkride preparation, career guidance, and aviation-related educational services. Users can browse instructors, schedule lessons, participate in virtual sessions, process payments, and access educational resources through the platform.

1. What information do we collect?
Personal information you disclose to us
In short: we collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise when you contact us. The personal information we collect may include: names, phone numbers, email addresses, mailing addresses, usernames, passwords, billing addresses, debit/credit card numbers, job titles, contact preferences, and contact or authentication data.
Sensitive information. When necessary, with your consent or as otherwise permitted by applicable law, we process student data as sensitive information.
Payment data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number and the associated security code. All payment data is handled and stored by Stripe. You may find their privacy notice at stripe.com/legal/privacy-center.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In short: some information — such as your IP address and browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services. This information is primarily needed to maintain the security and operation of our Services, and for internal analytics and reporting.

- Log and usage data — service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services, including IP address, device information, browser type and settings, and activity in the Services (date/time stamps, pages and files viewed, and other actions).
- Device data — information about the computer, phone, or tablet you use to access the Services, such as IP address, device and application identification numbers, browser type, hardware model, and operating system.
- Location data — information about your device's location, which can be precise or imprecise. You can opt out by refusing access to location information or by disabling your device's Location setting, though this may limit some Services functionality.

2. How do we process your information?
In short: we process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, including to:
- Facilitate account creation and authentication and otherwise manage user accounts.
- Deliver and facilitate delivery of the Services you request, including scheduling and hosting lessons.
- Respond to user inquiries and offer support to users.

- Fulfill and manage bookings, payments, and any returns or exchanges made through the Services.
- Enable user-to-user communication where the Services allow it (for example, between a student and an instructor).

5. How long do we keep your information?
In short: we keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice, unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than three (3) months past the termination of your account.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible, securely store it and isolate it from further processing until deletion is possible.
6. Do we collect information from minors?
In short: we do not knowingly collect data from or market to children under 18 years of age.
By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor’s use of the Services. If we learn that personal information from a user under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 7. What are your privacy rights?
In short: you may review, change, or terminate your account at any time, depending on your country, province, or state of residence.
Withdrawing your consent. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us using the details in How can you contact us about this notice? This will not affect the lawfulness of processing before the withdrawal.
Opting out of marketing. You can unsubscribe from our marketing and promotional communications at any time by clicking the unsubscribe link in the emails we send, replying “STOP” or “UNSUBSCRIBE” to any SMS messages we send, or by contacting us directly. You will then be removed from the marketing lists, though we may still send you service-related messages necessary for the administration and use of your account.
Account information
If you would like to review or change the information in your account, or terminate your account, you can log in to your account settings and update your user account directly. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal terms, and/or comply with applicable legal requirements.
Cookies. Most web browsers are set to accept cookies by default. You can usually set your browser to remove or reject cookies; doing so could affect certain features of our Services. For details, see our Cookie Policy.

8. Controls for Do-Not-Track features
Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized, so we do not currently respond to DNT browser signals. If a standard for online tracking is adopted that we must follow, we will inform you in a revised version of this Privacy Notice.
Global Privacy Control. We recognize and honor Global Privacy Control (GPC) signals. If you use a browser or extension that supports GPC, we will treat this as a valid request to opt out of the sale or sharing of your personal information for targeted advertising purposes under applicable state privacy laws, including the California Consumer Privacy Act (CCPA). 9. Do United States residents have specific privacy rights?

We retain each category above for as long as you have an account with us. We may disclose your personal information to our service providers pursuant to a written contract between us and each provider. We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months, and we will not sell or share personal information belonging to website visitors, users, and other consumers in the future.
Your rights
You have rights under certain US state data protection laws, though these rights are not absolute and in certain cases we may decline your request as permitted by law. These rights include the right to know whether we are processing your personal data, the right to access it, the right to correct inaccuracies, the right to request deletion, the right to obtain a copy of what you previously shared with us, the right to non-discrimination for exercising your rights, and the right to opt out of processing used for targeted advertising, the sale of personal data, or certain profiling. Depending on your state, you may also have the right to obtain a list of the categories or specific third parties we have disclosed personal data to, to review and correct how your data has been profiled, and to limit the use and disclosure of sensitive personal data.
How to exercise your rights
To exercise these rights, you can contact us by submitting a data subject access request, by emailing us at contact@pointnineaviation.com, or by referring to the contact details at the bottom of this notice. We will honor your opt-out preferences if you enact the Global Privacy Control (GPC) signal on your browser. Under certain state laws, you can designate an authorized agent to make a request on your behalf; we may deny a request from an agent that does not submit proof they are validly authorized to act for you.
Request verification and appeals
Upon receiving your request, we will need to verify your identity before acting on it. Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at contact@pointnineaviation.com. We will inform you in writing of any action taken or not taken in response to the appeal. If your appeal is denied, you may submit a complaint to your state attorney general.
California “Shine the Light” law
California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes.
